What is a personal injury?

In conversational terms, these are the events that nobody sees coming – where someone leaves with some type of injury; a slip and fall, a car accident, medical malpractice, nursing home abuse, dog bites, product liability, wrongful death.  Whether you find yourself as a Plaintiff in a personal injury lawsuit or as a Defendant, you should retain an Attorney to represent you, especially if the injury is severe.

In technical terms, the definition of a personal injury is straight forward, it is the result of an event which is harmful to a person’s body, mind or emotions. In terms of jurisprudence, a personal injury law suit asks the court to review the facts surrounding that event and find in favor of the Plaintiff using the tort laws of that jurisdiction.

These cases are heard in civil courts and must follow the rules of civil procedure in a specific jurisdiction as well as the laws of liability in that jurisdiction.   While the facts of the case may be summarized into a quick statement, “he wasn’t paying attention when he was driving and he hit me,” the procedure involved in trying a case isn’t nearly as simple.

Structured Settlements

Sometimes considering the means of distributing the cash award, if any, is just as challenging and important as winning a legal battle.  This type of planning should also be handled by an Attorney to assist the client in regarding their financial future.

Many Attorneys will evaluate a case before entering a fee agreement and you might be able to negotiate a payment structure with your legal team in certain cases.  In fact, many personal injury cases are litigated with a contingent legal fee agreement, in which you pay nothing unless you win the case.
