Immigration law is administered by the Department of Homeland Security and its sub-departments which used to be known as the Immigration and Naturalization Service. Immigration law is interpreted by United States Immigration Court, and decisions made by those courts and by the Department of Homeland Security may be appealed in some instances.
If a case can be appealed, the Board of Immigration Appeals is a branch of the US Department of Justice, which is a separate body than the Department of Homeland Security. This is an instance of our Federal Government’s system of “checks and balances.”
